🚨 The Income Tax Department is 𝗽𝗿𝗲𝗽𝗮𝗿𝗶𝗻𝗴 𝘁𝗼 𝗶𝘀𝘀𝘂𝗲 𝗶𝗺𝗺𝗲𝗱𝗶𝗮𝘁𝗲 𝗻𝗼𝘁𝗶𝗰𝗲𝘀 𝘁𝗼 𝗿𝗲𝘀𝗶𝗱𝗲𝗻𝘁 𝗜𝗻𝗱𝗶𝗮𝗻𝘀 𝗵𝗼𝗹𝗱𝗶𝗻𝗴 𝘂𝗻𝗱𝗶𝘀𝗰𝗹𝗼𝘀𝗲𝗱 𝗽𝗿𝗼𝗽𝗲𝗿𝘁𝗶𝗲𝘀 𝗮𝗯𝗿𝗼𝗮𝗱. Leveraging global intelligence networks, tax authorities have mapped out offshore real estate structures, systematically breaking through the traditional secrecy of foreign land registries.

🔍 The tracking system relies on a digital financial dragnet. Through the Common Reporting Standard (CRS) and foreign bank data sharing, authorities have traced automated mortgage payments, overseas rental deposits, and Ultimate Beneficial Owner (UBO) corporate shells back to Indian residents.

💥 The legal consequences are dictated by the draconian Black Money Act of 2015. Violators face a flat 30% tax on the current market value of the property, plus a mandatory 90% penalty—forcing a total financial liability of 120% of the asset’s worth, alongside 3 to 10 years of rigorous imprisonment.

📋 Even “clean money” property faces severe penalties if left unreported. Failing to explicitly declare any foreign asset in Schedule FA (Foreign Assets) of the Income Tax Return carries a standalone ₹10 Lakh penalty for non-disclosure, regardless of whether the property generated income.

💡 Affected taxpayers must act immediately before a formal notice lands. Once an inquiry under the Black Money Act is officially opened, voluntary rectification windows slam shut, making immediate consultation with a cross-border international tax expert an absolute necessity.

💡 The threat of imminent notices will inevitably push eligible evaders toward the ongoing amnesty window. Taxpayers holding assets below specified caps can seek refuge under the Foreign Assets of Small Taxpayers Disclosure Scheme (FAST-DS 2026), which runs until December 31, 2026. By paying a lower, structured tax and penalty, or a flat processing fee for mere reporting failures, individuals can gain absolute immunity from criminal prosecution under the Black Money Act before a formal investigation locks them out of relief.
