ST-1 Amended – In Concurrence to Positive List Approach (Notification 48/2012 – ST )
The central government has amended ST-1 proforma vide amending service taxrules to incorporate the resurrected positive listprovisions.
“a) in serial no.7, for registration of service tax now it is introduced thatDescription of taxable service( Choose from ANNEXURE). Effectively restoring the positive list registration provisions.
The annexure details out the nature of services as per earlier positive list. Please find below the original text of notification no. 48/2012 – ST dated 30thNovember, 2012.
Important Aspect of Notification :-
Sl. No 120 indicates ‘Other taxable services [services other than the 119 listed above]’. It is now mandatory to use any of 120 items for the purpose of registration unlike earlier where the requirement of mentioning the classification was only ‘if possible’.
NOTIFICATION NO 48/2012 – Service Tax
Dated: November 30, 2012
In exercise of the powers conferred by sub-section(1) read with sub-section (2) of Section 94 of the Finance Act, 1994( 32 of 1994), the Central Government hereby makes the following rules further to amend the Service Tax Rules, 1994, namely:-
1. (1) These rules may be called the Service Tax(Fifth Amendment) Rules, 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Service Tax Rules, 1994, in Form ST-1,-
